Real estate agency licensing: Slovenia

Licence required

Slovenia licenses individuals, not just agencies: only a broker holding a personal licence entered in the register may broker. Slovenian law is also the only one in the region that caps commission outright — at 4% of the contract value.

Authority and register

The competent ministry issues the individual licence and enters the broker in the register of real estate brokers.

Requirements for brokers

  • A ministry licence and entry in the register of real estate brokers.
  • At least higher vocational education.
  • A pass in the professional brokerage exam.
  • No final conviction for a property or economic crime carrying more than three months' imprisonment.
  • Mandatory refresher training every five years, or whenever the relevant rules change.
  • The real estate company must have liability insurance in place before it starts trading.

Mandatory insurance

The minimum sum insured is €150,000 per claim and €350,000 for all claims in a year. The insurer's name, policy number and sum insured must appear in the brokerage contract.

What a listing must contain

  • An ad must state the price, location, year of construction or last renovation, the size of the property, and the company's name and seat (Article 16 ZNPosr).
  • When several units in one building are advertised, the highest and lowest price per square metre must be given.
  • If the agency advertises its own property, this must be explicitly disclosed.

Commission and contract

Commission on a sale may not exceed 4% of the contract value; the cap does not apply when the property is worth less than €10,000. A contract breaching this is void.

Penalties

ZNPosr sets out fines for real estate companies that let unlicensed persons broker, and for breaches of the contract and advertising rules.

How to check an agency

Before you sign a brokerage contract:

  • Find the agency in the official register and match the name and company number against the contract.
  • Ask for its register number — in most countries it must appear in the listing itself.
  • Ask to see the professional indemnity policy and check that it is current.
  • Insist on a written contract stating the fee and exactly when it falls due.
  • Do not pay any advance on the commission before the deal closes — in most countries in the region that is expressly prohibited.
