Licence required

In 2022 Albania set brokerage up as a regulated profession: the certificate is issued by the Ministry of Justice, not a chamber, and is tied to the individual. The law was also driven by FATF and MONEYVAL commitments, so its focus is on the source of funds and broker integrity.

Authority and register

The Ministry of Justice issues the individual broker certificate and keeps the Register of Real Estate Brokers; supervision and discipline also sit with the ministry.

Requirements for brokers

  • A Ministry of Justice certificate and entry in the Register of Brokers — without it brokerage is prohibited in any form.
  • Full legal capacity and completed upper secondary education.
  • No investigation or conviction for money laundering, terrorism financing or weapons of mass destruction, nor for other intentional crimes.
  • Mandatory training of at least 60 hours (Albanian School of Public Administration, accredited universities or professional associations approved by the minister).
  • Foreign nationals must additionally prove command of Albanian; EU-licensed brokers may work through a cooperation contract with an Albanian office.
  • The minister issues the certificate within 60 days of a complete application.

Mandatory insurance

The law does not require professional indemnity insurance — in this Albania differs from the rest of the region.

What a listing must contain

  • When operating electronically or remotely, the broker must disclose their identity, certificate number and the entity's unique tax identification number (NIPT).
  • Advertising to promote a property to third parties is expressly part of brokerage activity — only a certified broker may do it.
  • The broker must display general terms and fees in a visible place.

Commission and contract

The brokerage contract must be in writing or it is void; if no term is set, it is deemed concluded for six months. The fee is earned when the object of the contract is fulfilled, and partial payment before conclusion is not allowed.

Penalties

Disciplinary measures: written warning, a fine of ALL 50,000–500,000, mandatory extra training, suspension of one to five years, and final revocation of the certificate with removal from the register.

How to check an agency

Before you sign a brokerage contract:

  • Find the agency in the official register and match the name and company number against the contract.
  • Ask for its register number — in most countries it must appear in the listing itself.
  • Ask to see the professional indemnity policy and check that it is current.
  • Insist on a written contract stating the fee and exactly when it falls due.
  • Do not pay any advance on the commission before the deal closes — in most countries in the region that is expressly prohibited.
